MYSUN is an engineering based marketplace for products and services related to solar energy and energy efficiency. MYSUN also provides value-added design and engineering, site visit, operations and maintenance, financial, sourcing, trading and marketing services in the field of solar energy and energy efficiency. Any person visiting, accessing or using the Website or the services offered therein (hereinafter referred to as "User", "You"), shall be deemed to have unconditionally accepted all of the terms, conditions and notices contained in this Terms of Use, along with its Privacy Policy, and any other policy/document incorporated by way of reference, including any amendments made from time to time by MYSUN at its sole discretion and posted on the Website.

From time to time EnergySage shall provide Content (as defined below), together with certain resources and services, all as described more fully on the Site (the "Services"). The Services EnergySage provides to you may include, but not be limited to, the following: calculators, estimators, proposal solicitation platforms, graphical representations of financial and energy performance data, dashboards, self-evaluation guides (wizards), maps, summaries, digests, member forums, and web logs (blogs); information concerning third-party vendors including, but not limited to, product manufacturers, installers and other contractors, lenders and financial institutions (“Third-Party Vendors”); and product and service descriptions, including materials provided by Third-Party Vendors (whether such materials are delivered to you via the Site or through the Services, or delivered to you directly by a Third-Party Vendor in response to a Submitted Request, as defined in Section IV below, “Requests for Information and Services”). Your acceptance of these materials, whether displayed or transmitted on the Site, or through the Services by means including, but not limited to, text, User comments, messages, information, data, graphics, articles, brochures, photographs, images, illustrations, software, audio clips, and video clips (collectively, "Content"), is subject to these TOU. EnergySage may change, suspend or discontinue the Services, including any Content, at any time, for any reason. EnergySage may also place limitations on certain features and Services, or restrict your access to parts of or all of the Services, without notice or liability.

It is hereby clarified that for the purposes of this Terms of Use, Privacy Policy and any other document and policy incorporated by reference herein, the term "User"/"You" means any person (natural or legal) who visits, accesses and uses the Website and shall include: (i) Partners (including but not limited to suppliers, vendors, project developers, construction contractors, consultants, builders, chartered accountants, and financers/lenders, or employees thereof, providing solar energy related services and products) registered on the Website as a partner; (ii) Unregistered Users (person who visits and accesses the Website, but does not register on the Website); and (iii) Registered Users (Users who register on the Website for the purpose of identifying appropriate Partners and/or procuring the MYSUN Services, and/or other services or products from Partners). It is further clarified that Registered Users may also act as Partners in their respective capacities and as such therefore their respective rights and obligations would accordingly be determined.
2. MYSUN intends to provide the following services:
   1. Basic Services
      1.  Enable Registered Users to connect with, and procure services or products from, Partners;
      2. Enable Partners to connect with, advertise and sell their products or services to Unregistered Users and/or Registered Users;
   2. Additional Services: provide certain services in addition to the Basic Services to Users as defined in accordance with the terms contained in this Terms of Use.

 

This document is to be treated as an electronic record, within the meaning accorded to it under the Information Technology Act, 2000 (hereinafter referred to as the “IT Act”) and the rules made thereunder as applicable, which may be amended from time to time. Any Information or advice provided on the Website including but not limited to: (i) the estimates/outputs of the MYSUNCalculator™ available on the Website, and any recommendations related thereto; and (ii) advice, opinion or recommendations given by the MYSUN Team should be used merely as a guide rather than a definitive recommendation for any specific installation or undertaking any action. You agree and acknowledge that the said estimates, outputs and/or advice of the MYSUNCalculator™ is based on the inputs provided by You and certain assumptions, and that the factors such as system design, quality, cost, operations & maintenance and conditions present at the site may impact the actual results. 4. It is not MYSUN's responsibility to ensure that your use of the Website complies with all local laws applicable within your country. Further, by using this Website and/or submitting information including any personally identifiable information on the Website, You hereby expressly consent to the transfer of such data to India, and to the processing of such data on MYSUN's Indian servers, where your data will be governed by laws applicable within India that may provide a level of data protection and entail other compliances different from your country.
5. You agree and acknowledge that unless expressly stated in writing on the Website, nothing contained therein shall constitute an offer or promise to deliver any products and/or services by MYSUN.

MYSUNCalculator^TM is an online indicative tool to enable Users to calculate the financial impact of using solar energy solutions for their respective energy needs. This tool can be used by Users across various consumer categories e.g. Residential, Commercial or Industrial consumers. This tool is available in two different models – Basic and Advanced.

MYSUNCalculator^TM relies on advanced algorithms related to your locational co-ordinates, historical solar irradiation, electricity tariffs across-India and certain generic assumptions related to the electricity consumption pattern of Users, availability of area for solar installation, nearby shading, solar irradiation, availing of a bank loan to buy solar system, etc. You can edit and modify a lot of these assumptions for more accurate results. All the estimates, outputs and recommendations of this tool are based on these assumptions.

It is understood that the actual results may vary from User to User depending on the actual ground conditions specific to the User. It is also understood that any result obtained from the MYSUNCalculator^TM is also based on the inputs provided by You. MYSUNCalculator^TM may not take into account all of the variables that may affect the actual installation or output of the solar energy system at Your site. The conditions prevalent at the site may impact the actual result and/or installation. You are advised to get a detailed assessment and/or calculation before undertaking actual installation or any work/services related thereto.

MYSUN makes constant endeavors to collate and refer to a comprehensive and updated range of data and information (such as consumer tariff, regulatory orders, government policies, and other relevant information) related to energy services including solar related services in India. Therefore, the results of the MYSUNCalculator^TM may vary over time as the data may be updated and modified from time to time.

Notwithstanding the above, it should also be noted that due to the very nature of information, which is evolving on a continuous basis, it is impossible to guarantee that all the data used for the MYSUNCalculator^TM shall always be completely accurate and up to date.

MYSUN may also provide comparison of the potential savings and benefits that may be incurred as a result of the installation of energy systems with returns that may be obtained from investment products such as a fixed deposit or mutual fund for instance. Please note that any such comparison made is only for illustrative purposes, and cannot be taken as a representation made by MYSUN under any circumstances.

Further, MYSUN gives no warranty, express or implied, as to the accuracy, reliability and completeness of any information, formulae or calculations provided through the use of the MYSUNCalculator^TM. You agree that any reliance placed by You on any result obtained from the MYSUNCalculator^TM is solely at Your own risk and MYSUN does not accept any liability for loss or damage of whatsoever nature, which may be attributable to the reliance on and use of the MYSUNCalculator^TM .

1. By visiting, accessing or using the Website www.itsmysun.com, you shall be deemed to have unconditionally accepted this Privacy Policy read with the Terms of Use which govern the submission and usage of your information on the Website. You agree and confirm that the Privacy Policy may be amended from time to time without prior notice. Please ensure that you periodically update yourself with the current version of the Privacy Policy. Further, your continued access of the Website whether automated or otherwise, will signify your unconditional consent to and acceptance of the Privacy Policy including any modifications made from time to time, if any. This policy does not apply to the privacy practices of companies or organizations that are not owned or controlled by MYSUN. 2. This Privacy Policy shall commence from the date on which you first visit and access the Website, and shall be co-terminus with the Terms of Use.

3.1 It is not necessary for you to provide MYSUN with personal information in order to visit and access the Website or read content that may be available publically on the Website.
3.2 You may be required to submit personal information to: (a) complete the registration and verification process; and (b) avail MYSUN Services and/or services provided by a Partner, as the case may be. It is hereby clarified that for the purposes of this Privacy Policy, the term ‘personal information’ may include information that can be associated with a specific person, and can be used to uniquely identify or contact a person such as name, username, password, phone number, email address, or any such other information as may be determined necessary to be obtained from you by MYSUN from time to time. Provided, however, information regarding the physical attributes of your property, including building type, the details of the existing energy systems on your property, and other information that cannot be used to uniquely identify or contact a User does not, by itself, qualify as personal information.
3.3 In addition to the above, an Unregistered User may choose to use the MYSUNCalculator™ to obtain estimates/outputs and any recommendations related thereto. In such cases, an Unregistered User may also be required to submit certain inputs such as a photographic map or details of address including street address, the details of the city or town, and the pin code. MYSUN may share such information with the Partners or other third parties to deliver or promote the My Sun Services and other services available vide the Website. Please note that MYSUN will not record the name or email address of an Unregistered User unless such Unregistered User subscribes to receive information via electronic mail, or such Unregistered User chooses to become a Registered User, and provides its personal information to MYSUN and/or Partners, as the case may be.
3.4 MYSUN may also employ a third party vendor/service provider to provide payment facility to collect any fees and/or charges payable by you. Any information (including personal information) that you may provide to such third parties shall be governed by their respective privacy policies. We encourage you to read the privacy policy of such third parties and contact the said third parties directly if you wish to learn more about their respective privacy policies and practices. We shall not store any of your financial information, such as your bank routing or account numbers, or your debit or credit card account numbers.

4.1 MYSUN may collect certain information from you, including but not limited to domain name or IP address and other information, which cannot be used to uniquely identify or contact you, and does not, by itself, qualify as personal information. Further, additional non-personal information may be collected from you through the use of “cookies”, and other standard tracking technology such as pixel tags. Such non personal information may be used for the purpose of generating analytics, prepare statistical reports, track the services used, and pages visited by a you.
4.2 MYSUN does not facilitate the merging of personally identifiable information with non-personally identifiable information that is collected unless you have specifically and affirmatively provided MYSUN with your consent to such merger. In the event your personal information cannot be separated from the non-personal information, then it will be treated as personal information. Provided, however, MYSUN shall have the sole discretion to determine whether it is possible to separate the personal information from the non-personal information.
